1. ACCEPTANCE OF TERMS
Welcome to FTG, also known as For The Girlies (βFTG,β βwe,β βus,β or βourβ).
These Terms of Service (βTermsβ) govern your access to and use of our website, online store, customer accounts, community features, products, services, and related digital content (collectively, the βServicesβ).
By accessing our website, creating an account, placing an order, participating in our community, or otherwise using our Services, you agree to be bound by these Terms and our applicable policies.
If you do not agree to these Terms, you must discontinue using our Services.
Your use of the Services is also subject to our Privacy Policy, Shipping Policy, and Refund and Return Policy, as applicable.
We reserve the right to modify these Terms in accordance with Section 25.

Unless and until a separate legal entity is formally established and assumes operation of the business, FTG operates as a business name used by its individual owner.
References to FTG, For The Girlies, or the business name do not independently establish the existence of a corporation, limited liability company, or other separate legal entity.
FTG may utilize third-party technology providers, payment processors, manufacturers, distributors, fulfillment partners, and shipping carriers to support its operations.
Such third parties remain responsible for their own independent services and obligations, subject to applicable law and contractual arrangements.
3. ELIGIBILITY AND ACCOUNT REGISTRATION

Customers should discontinue use and seek appropriate medical advice if irritation, swelling, allergic reactions, or other adverse symptoms occur.
Products intended for use near the eyes must be applied with particular care and according to their instructions.
FTG does not represent that any product is suitable for every individual.
Product descriptions and marketing materials are provided for general informational purposes and are not intended to constitute medical advice, diagnosis, or treatment.
FTG does not guarantee particular cosmetic outcomes unless an express guarantee is clearly provided.
Nothing in this section excludes liability arising from defective products, legally inadequate warnings, negligence, misrepresentation, or other matters for which liability cannot lawfully be excluded.
6. THIRD-PARTY MANUFACTURERS AND FULFILLMENT
Certain products offered through FTG may be manufactured, supplied, packaged, or fulfilled by independent third-party providers.
These providers may include dropshipping suppliers, private-label manufacturers, print-on-demand providers, and fulfillment services.
FTG may rely on such providers for product production, inventory management, packaging, and delivery.
Product packaging, fulfillment locations, and delivery methods may vary depending on the supplier.
Although FTG may not directly manufacture every product sold, we remain responsible for obligations imposed on us as a seller under applicable law.
FTG does not disclaim legally nonwaivable responsibilities merely because a third party manufactured or fulfilled an order.
We may change suppliers or fulfillment arrangements without advance notice, provided such changes do not materially alter the products or rights associated with an accepted order.
7. PRICING, PAYMENT, AND TAXES
All prices are displayed in United States dollars unless otherwise indicated.
Applicable sales taxes, shipping fees, and other disclosed charges will be calculated or displayed during checkout.
FTG uses third-party payment processing services to facilitate transactions.
By submitting payment information, you represent that you are authorized to use the selected payment method.
You authorize the processing of charges associated with your purchase, including applicable taxes and disclosed fees.
FTG does not guarantee that all payment methods will remain available.
Orders may be declined or canceled where payment authorization fails or where there is a reasonable indication of fraud.
We do not impose undisclosed charges or waive any statutory consumer rights through this section.
8. ORDER ACCEPTANCE AND CANCELLATION
Submitting an order constitutes an offer to purchase the selected products.
An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance.
FTG may decline or cancel orders for legitimate reasons, including:
- Product unavailability.
- Payment authorization failure.
- Suspected fraud.

- Violations of these Terms.
If FTG cancels an order after payment has been collected, the amount paid for the canceled items will be refunded to the original payment method, unless otherwise required by law or agreed with the customer.

Once an order has entered processing or fulfillment, cancellation may no longer be possible.
Any cancellation restrictions remain subject to applicable consumer protection laws and our published policies.
9. SHIPPING AND DELIVERY
FTG may ship products through third-party fulfillment partners and independent carriers.
Shipping estimates are provided for informational purposes and are not guaranteed delivery dates unless expressly identified as guaranteed.
Delivery times may be affected by:

- Carrier operations.
- Weather conditions.

- Holidays.
- Address inaccuracies.
- Circumstances outside FTGβs reasonable control.
Where an order contains products supplied by different fulfillment partners, items may arrive in separate shipments.
FTG will provide shipping and tracking information when available.
Customers are responsible for providing accurate delivery information.
FTG will investigate reported delivery issues and provide remedies where required by applicable law or our published policies.
A carrierβs designation of an item as βdeliveredβ does not automatically eliminate any rights or remedies available to the customer.
Our separate Shipping Policy provides additional information concerning processing, delivery, and fulfillment.
10. RETURNS, REFUNDS, AND HYGIENE REQUIREMENTS
Due to the hygienic nature of certain cosmetic products, some opened, used, or unsealed items may be ineligible for discretionary returns.
Return eligibility depends on the product category, its condition, our published Refund and Return Policy, and applicable law.
FTG may establish reasonable hygiene-related return restrictions for items such as mascara, false eyelashes, lip cosmetics, and other personal-care products.
However, such restrictions do not eliminate legal remedies involving defective, damaged, materially misdescribed, or otherwise nonconforming products.
Customers should report problems promptly and provide relevant order details.
Photographs may be requested where reasonably necessary to evaluate a claim.
FTG will not require customers to surrender statutory rights as a condition of obtaining legally required remedies.
Refunds will generally be issued to the original payment method unless another lawful method is agreed upon.
Our Refund and Return Policy governs additional procedures and eligibility requirements.
11. PROMOTIONS, DISCOUNTS, AND SPECIAL OFFERS
FTG may offer promotional pricing, discount codes, giveaways, contests, and limited-time offers.
Promotions may be subject to additional disclosed terms.
Unless otherwise stated, promotional offers:
- Have no cash redemption value.
- May not be combined with other offers.
- May be limited by product, customer, quantity, or time.
- May be discontinued prospectively.
FTG may reject fraudulent or unauthorized use of promotional codes.
Where a promotion constitutes a sweepstakes, contest, or other regulated activity, separate official rules may apply.
FTG will not condition entry into a chance-based sweepstakes on a purchase unless permitted by applicable law.
12. INTELLECTUAL PROPERTY
The FTG name, For The Girlies branding, original website design, original photographs, graphics, written materials, logos, and other proprietary content may be protected by copyright, trademark, and other intellectual property laws.
Except where expressly authorized, users may not reproduce, distribute, commercially exploit, modify, or create derivative works from FTG-owned materials in a manner that infringes applicable intellectual property rights.
Nothing in these Terms transfers ownership of FTG intellectual property to customers or website visitors.
Third-party trademarks and materials remain the property of their respective owners.
Use of a third-party platform or supplier does not imply that FTG owns that providerβs intellectual property.
13. THE GIRLIES COMMUNITY
FTG may provide an online community known as βThe Girlies.β
Community features may allow registered users to:
- Create profiles.
- Share beauty-related content.
- Publish photographs.
- Discuss cosmetics and makeup techniques.
- Comment on other usersβ submissions.
- Participate in community activities.
- Submit content for potential promotional recognition.
Participation is voluntary and subject to these Terms and any additional community guidelines.
Users are responsible for the content they submit.
FTG reserves the right to moderate community activity and remove content that violates applicable rules.
We do not guarantee that all user-generated content will be reviewed before publication.
14. USER-GENERATED CONTENT AND LICENSE
Users retain ownership of original content they submit to The Girlies community.
By posting content, users grant FTG a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and technically modify that content as reasonably necessary to operate and promote the community and its features.
This license includes displaying submitted content within the FTG website and associated community interfaces.
FTG will seek additional permission where legally required before using an identifiable personβs image or likeness in paid advertising or other commercial endorsements.
Users represent that they own or possess the rights necessary to submit their content.
Users must not upload material that infringes another personβs copyright, privacy rights, publicity rights, or other legally protected interests.
Users may request removal of their content through available account controls or by contacting FTG.
Removal requests will be handled in accordance with applicable law, technical limitations, and legitimate recordkeeping obligations.
15. COMMUNITY CONDUCT AND PROHIBITED ACTIVITIES
Users must not engage in conduct that undermines the safety, security, or integrity of the FTG community.
Prohibited activities include:
- Harassment, threats, bullying, or intimidation.
- Hate speech or discriminatory abuse.
- Fraudulent activity or impersonation.
- Publication of another personβs private information without authorization.
- Unauthorized commercial solicitation or spam.
- Uploading malicious software.
- Attempting to compromise website security.
- Posting unlawful or infringing content.
- Sharing sexually explicit material prohibited by community rules.
- Manipulating contests, votes, reviews, or community rankings.
- Misrepresenting paid endorsements or promotional relationships.
FTG may remove content, restrict features, suspend accounts, or terminate access when reasonably necessary to enforce these rules.
We may also preserve or disclose information where required by lawful process.
Moderation decisions do not create a general obligation to monitor every communication.
16. CUSTOMER REVIEWS AND ENDORSEMENTS
Customers may submit product reviews, testimonials, ratings, and other feedback.
Reviews must reflect genuine experiences and must not contain knowingly false or misleading statements.
FTG will not require customers to provide positive reviews.
FTG will not penalize customers solely for submitting truthful negative reviews.
Where reviews or endorsements involve compensation, free products, discounts, affiliate relationships, or other material incentives, appropriate disclosures may be required.
FTG may remove reviews that contain unlawful content, spam, personal information, or other material unrelated to legitimate consumer feedback.
Nothing in these Terms restricts rights protected under the Consumer Review Fairness Act or other applicable laws.
17. PRIVACY AND PERSONAL INFORMATION
FTG collects and processes personal information as described in its separate Privacy Policy.
Information may include account details, contact information, shipping addresses, transaction records, device information, and community submissions.
Certain information may be processed by third-party service providers supporting website operations, payment processing, analytics, customer accounts, and order fulfillment.
FTG will maintain privacy practices consistent with applicable legal obligations.
Users should review the Privacy Policy for information concerning data collection, disclosure, retention, security, and applicable privacy rights.
These Terms do not independently authorize data practices that require separate consent under applicable law.

Except for express warranties provided by FTG or warranties that cannot lawfully be excluded, the Services and products are provided subject to applicable warranty laws.
To the maximum extent permitted by law, FTG disclaims implied warranties only where such disclaimers are legally valid and properly communicated.
Nothing in these Terms limits applicable express warranties, statutory consumer protections, or rights arising from defective or nonconforming goods.
FTG does not warrant that the website will operate continuously or without interruption.
We will make commercially reasonable efforts to maintain website functionality and address technical problems.
No provision in this section should be interpreted as eliminating a remedy that applicable law requires us to provide.
21. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, FTG will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services where such damages may lawfully be excluded.
This limitation does not apply where prohibited by law.
Nothing in these Terms excludes or limits liability for:
- Fraud or intentional misconduct.
- Gross negligence where liability cannot lawfully be limited.
- Personal injury or property damage where applicable law prohibits exclusion.
- Defective products where statutory liability applies.
- Violations of nonwaivable consumer protection laws.
- Other liabilities that cannot legally be disclaimed.
Any contractual limitation of damages will be interpreted only to the extent enforceable under applicable law.
No limitation contained in these Terms should be understood as a guarantee that FTG or its owner cannot be sued.
22. CUSTOMER RESPONSIBILITIES AND INDEMNIFICATION
Users agree to use the Services lawfully and in accordance with these Terms.
To the extent permitted by applicable law, users agree to indemnify FTG against third-party claims arising directly from their unlawful conduct, intentional misconduct, or infringement of another partyβs intellectual property rights.
This provision does not require customers to indemnify FTG for FTGβs own negligence, unlawful conduct, defective products, or other matters for which shifting liability would be prohibited.
FTG may participate in the defense of claims subject to an otherwise enforceable indemnification obligation.
23. DISPUTE RESOLUTION
FTG encourages customers to contact us before initiating formal legal proceedings so that disputes may be reviewed and potentially resolved informally.
Customers may submit disputes concerning orders, refunds, account access, or other matters through our published customer support channels.
FTG will make reasonable efforts to investigate and respond.
Nothing in these Terms prevents customers from:
- Filing complaints with appropriate government agencies.
- Exercising nonwaivable consumer rights.
- Bringing claims in a court with proper jurisdiction.
- Seeking relief available under applicable law.
The parties may voluntarily agree to mediation or another lawful dispute resolution procedure after a dispute arises.
These Terms do not impose mandatory arbitration or a class-action waiver.
Any future arbitration provision must be separately drafted, reviewed, and implemented in a manner consistent with applicable law.
24. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles, except where mandatory laws of another jurisdiction apply.
Disputes may be brought before courts possessing appropriate subject-matter and personal jurisdiction.
Nothing in this provision deprives consumers of protections that cannot lawfully be waived.
25. MODIFICATIONS TO THESE TERMS
FTG may update these Terms to reflect changes in business operations, products, technology, legal requirements, or website features.
The effective date will be updated when revisions are published.
Where legally required, FTG will provide advance notice or obtain consent before material changes become effective.
Changes will not retroactively eliminate rights or remedies associated with completed transactions where doing so would be unlawful.
Continued use of the Services after legally effective changes may constitute acceptance of the updated Terms where permitted by law.
26. TERMINATION AND SUSPENSION
FTG may suspend or terminate access to the Services for legitimate reasons, including violations of these Terms, fraudulent conduct, or threats to website security.
Termination does not automatically cancel rights or obligations arising from previously completed transactions.
Customers remain entitled to refunds, remedies, and protections required by applicable law.
Provisions that reasonably should survive termination, including intellectual property rights, lawful liability limitations, and dispute-related provisions, may remain effective.
27. SEVERABILITY
If a court of competent jurisdiction determines that a provision of these Terms is invalid or unenforceable, the remaining provisions will continue in effect to the extent legally permissible.
An invalid provision will not be enforced beyond the limits permitted by law.
28. NO WAIVER
FTGβs failure to enforce a provision of these Terms on one occasion does not automatically constitute a waiver of its right to enforce that provision in the future.
Any waiver must be legally valid and applicable to the specific circumstances involved.
29. ENTIRE AGREEMENT
These Terms, together with applicable policies and any additional terms expressly accepted by the customer, constitute the agreement governing use of the Services.
In the event of a conflict between these Terms and a mandatory legal requirement, the applicable law controls.
Product-specific terms and separately disclosed promotional conditions may apply where legally enforceable.
30. BUSINESS TRANSFERS AND FUTURE ENTITY FORMATION
FTG may undergo organizational changes, including the formation of a limited liability company or transfer of business operations to another legally recognized entity.
If such a change occurs, applicable contractual rights and obligations may be transferred or assigned only to the extent permitted by law.
Where required, customers will receive appropriate notice concerning changes to the identity of the business operator or the handling of personal information.
The formation of a future limited liability company does not automatically eliminate obligations incurred before its formation.
Until a new legal entity formally assumes operation of FTG, the business remains operated by its current legal owner.
31. FORCE MAJEURE
FTG will not be responsible for delays or failures in performance caused by extraordinary events beyond its reasonable control to the extent relief is permitted by applicable law.
Such events may include natural disasters, major transportation disruptions, widespread infrastructure failures, government restrictions, and other unforeseen circumstances.
FTG will take commercially reasonable steps to mitigate disruptions.
This provision does not eliminate obligations to provide refunds or other remedies where required by law.
